Dear all

It was very nice to meet all of you on July 3 and I believe we have a very fruitful start towards our networking. I am sure we would like to thank Anthony for the sponsorship of the event by the Croucher Foundation. Anthony’s remarks towards the end of our discussion is especially welcome!

Appended herewith, please find the information on the Uniform Biological Material Transfer Agreement for your perusal. I would highly recommend the universities becoming a signatory as you will save a lot of time and effort in having a MTA signed between signatories.

Throughout our discussions, I believe we have reached some consensus

1.) networking and exchange of information is important;
2.) background IP should be taken into consideration in a negotiation;
3.) future rights and improvements should not be granted light heartedly;
4.) certain cash flow in a tech transfer deal is desirable;
5.) better to reach an agreement with a sponsoring company in a UICP deal before a proposal is submitted;
6.) confidentiality agreements should be treated with caution;
7.) an assignment of rights will limit both future development and use of a technology by the assignor;
8.) patent application is an expensive exercise and filing should be made discriminately;
9.) Government officials would be invited to our discussions in due course.

There are other issues that we have not had enough time to discuss:

1.) university's involvement in formation of companies or as a partner in a joint venture;
2.) student's IP rights;
3.) what can be done to encourage innovation and technology in Hong Kong;
We have also agreed on a subsequent meeting in October 2003.

Please let me know:
1) topics you would like to discuss in the upcoming meeting;
2) dates in October when you would definitely not be available.

Upon receipt of the above information from you, I shall work with Anthony to set the next meeting details.
